The purpose of this warning is for Southern European Cluster in Photonics and Optics (hereinafter “SECPhO”), whose registered address is C/ Telers 5, escalera B, 2a Planta, oficina 12, 08221 Terrassa, Spain, and whose e-mail address is info@secpho.org , to inform the user (hereinafter “Users”) of the website at the URL www.secpho.org (hereinafter “the Site”) of its policy for the protection of personal data (hereinafter “Data”). The aim is to preserve and guarantee the user’s privacy at all times strictly in accordance with Spain’s Organic Law 15/1999 of 13 December on Personal Data Protection (the “Data Protection Act”) SECPhO informs you that when you fill in the contact form and click on “Send” or provide information through e-mails to SECPhO, your personal details will be processed and added to a database belonging to SECPhO and for which SECPhO is responsible to all legal effects.
The aim of collecting this data is to offer the latest updates, articles, opinions and news related to SECPhO activities and to the optics and photonics industry in general, and to be able to send users forms for joining SECPhO or other estimates or proposals. Likewise the data collected will be used to send users information about SECPhO’s services by e-mail In all cases Users must have given their prior consent. Refusal to provide the data requested will result in the user being barred from the aforementioned services.
SECPhO will not release the data to other individuals or legal entities without the user’s prior written consent.
As stipulated in the DATA PROTECTION ACT, users have the right to access, rectify, cancel and oppose the processing of their personal data held in the database for which SECPhO is responsible. Users may change or delete their personal data by emailing info@secpho.org stating their National Identification Number, full name, place of residence, postal address and e-mail address. For security reasons the user must respond to a confirmation e-mail before these personal data are deleted.
SECPhO guarantees, as stated in the DATA PROTECTION ACT, that personal data will be treated confidentially and that the server where they are processed and stored is protected by security measures which ensure that unauthorised third parties cannot gain access to the data.
Finally, the User declares that the information provided to enable access to the Site and while using it is true, complete and accurate and he or she undertakes to keep this information up to date.
Conditions of use
Access to the website
This disclaimer (hereinafter “Disclaimer”) regulates the use of the site (hereinafter “the Service”) that the Southern European Cluster in Photonics and Optics (hereinafter “SECPhO”) provides for Internet users at the following URL: www.secpho.org (hereinafter “the Site”). Access to the Site is subject to users reading and accepting the Disclaimer and entails the status of user (hereinafter “the User”) and the full and unconditional acceptance by the User of all the terms stated in the Disclaimer, as specified in the version published by SECPhO at the moment when the User accesses the Service.
To contact SECPhO via the forms on the Site, the User must provide SECPhO with personal information. By filling in and sending the form the User accepts and authorises the use of this personal information by SECPhO, as stated in the privacy policy published in the “Privacy policy” section on the Site. SECPhO reserves the right to check the User is complying with the Disclaimer by means of any computer devices and techniques for Internet monitoring or any other method that might be used to verify the information provided, in order to ensure the proper use of the Service by the User.
The User explicitly and unconditionally accepts that access to and use of this website takes place under his or her own exclusive responsibility.
The User must use the Site and its content in a diligent and proper way in accordance with the law, the terms of this Disclaimer and any other regulations that may be applicable, and in the interests of good practice and public order.

The User may not authorise the use in part or in whole of the services provided by the Site or third parties for his or her own business activity unless previously agreed to by SECPhO.
The Service
The Service means all the services provided by SECPhO on the Site, which are currently the following: Consulting, advice, promotion of activities, market and technological research, network tools, consulting.
Also included are the dissemination of articles, studies, information and in general any technical and scientific material on optical metrology (hereinafter “the Content”) provided by SECPhO.
Proper use of the Content
The User agrees to use the Content appropriately and in a law-abiding way and specifically to refrain from (a) using the Content in an immoral or illegal manner, (b) providing public access to the Content by any public or private media, (c) removing, avoiding or manipulating the copyright and other data that identifies the rights of SECPhO, and (d) reproducing, copying, altering, modifying or divulging the Content provided through the Service in any way to unauthorised third parties or selling any information obtained from the Service.
All of the Site’s content (including, without restriction, texts, graphics, icons, databases, images, text files, audio and video material and software) is the rightful property of SECPhO or of other content providers and is protected by national and international industrial and intellectual property regulations. The compilation (including the collection, ordering and assembly) of all the website’s content is the exclusive property of SECPhO and is protected by national and international industrial and intellectual property regulations.
Any reproduction, modification, copying, use, distribution, marketing, public communication and any other use of the information featured on the Site (including its design, configuration and presentation) constitutes an infringement of the prevailing legislation governing intellectual property rights.
Liability for damages
The User will be liable for any damages that SECPhO may suffer as a direct or indirect consequence of the infringement of any of the obligations derived from the Disclaimer or from the law in relation to the use of the Site.
Use of the Service under the exclusive responsibility of the User.
The User acknowledges and voluntarily accepts that the use of the Service and its Content takes place in all cases under the User’s exclusive responsibility. SECPhO will not be liable for any consequences arising from the use of the Service and will not accept any liability for its Content.
SECPhO does not warrant the availability and continuity of the Service.
Furthermore, SECPhO does not warrant the absence of viruses and other elements in the Content that may lead to alterations in the User’s computer system (software and hardware) or in the electronic documents and files stored on the User’s computer. SECPhO does not accept any liability for any damage or loss that may arise as a result of the presence of viruses or any other harmful elements in the Content provided by SECPhO that may result in modifications in the User’s computer system.
SECPhO will clearly identify any information used for advertising purposes.
Privacy in the use of the Service
SECPhO does not warrant privacy and security in the use of the Service and in particular does not warrant that unauthorised third parties will not become aware of the type, conditions, characteristics and circumstances associated with the use of the Service by Users. SECPhO does not accept any liability for any damage or loss that may arise as a result of the knowledge of unauthorised third parties of the use of the Service by Users.
Denying or withdrawing access to the Service
SECPhO reserves the right to update the content of the Site and to temporarily or permanently eliminate, limit and prohibit access to it.
If the User believes that events are occurring in the Services of the Site that are contrary to the provisions of this Disclaimer, he or she should notify SECPhO by emailing info@secpho.org. SECPhO states that it will do everything within its power to eliminate from the Site’s Services any statements that violate any right or law as soon as possible after it receives notification thereof, including the reasons and the identification of the sender.
Applicable law and jurisdiction
This disclaimer and any relations between the User and SECPhO will be governed by Spanish law.
